One Toke Over the Line...

The City of Tacoma has begun to enforce rules governing marijuana-related businesses. Three businesses this week received letters from the City warning them that their business licenses had been revoked.

As the letters remind the businesses, possessing, delivering, or manufacturing marijuana is a crime in Washington State, as is delivering marijuana to more than one person. It is also a crime under the Tacoma Municipal Code and federal law. TMC also makes it a nuisance to smoke or ingest marijuana anywhere other than a private residence.

According to the TNT this is just the beginning of Tacoma’s crackdown on marijuana-related businesses that are determined to be operating out of compliance. The City will continue to evaluate businesses and act on those found to be out of compliance. Collective gardens will be largely left alone, if they are not found to be a nuisance, but dispensaries will be closed down.

An attorney representing many of Tacoma’s medical marijuana businesses says he’s advising his clients not to follow the City’s directions to cease business activity. He also had this piece of advice for his clients, according to the TNT:

He advises his medical-marijuana clients to insist on a formal sign-in and sign-out procedure, he said, in which they join the collective upon entering and resign when they go out.

Hm. Well, it sounds like we’ll be hearing more about this.

    After wrestling with that bit of ‘moral’ ordinance, I’m sure everyuone responsible celebrated with drinks all ‘round, eh?

    There’s a hierarchy of law in this country:
    Federal law trumps state law.
    State law trumps county law.
    County law trumps city law.

    Pot is not legal on the Federal level so this argument is moot.
