Resolution No. 38138 set Tuesday, November 16,2010, at approximately 5:30 p.m., as the date for the second public hearing by the City Council on the 2011-2012 Biennial Budget and the 2011-2016 Capital Facilities Program.
Resolution No. 38139 set Tuesday, November 16,2010, at approximately 5:30 p.m., as the date for a public hearing by the City Council on the amended Six-Year Comprehensive Transportation Program for amended year 2010 and 2011-2016.
PROCLAMATIONS, RECOGNITIONS, PRESENTATIONS, AND ANNOUNCEMENTS
Mayor Marilyn Strickland read a proclamation naming November 2010 as American Diabetes Month in the City of Tacoma.
PUBLIC COMMENT
- One person spoke about the noise enforcement ordinance, who suggested that the barking dog provision be reworded in the noise ordinance. He said the law as written places the burden on the victim of the noise violation, not on the owner to keep their pets quiet. He described the habits of a neighbor who owns five dogs as “city-sponsored harassment.”

RESOLUTIONS
Purchase Resolution No. 38140 awarding contracts to:
- The H.D.D. Company, Inc., on its bid of $863,470.00, including sales tax, plus a 10 percent contingency, for a cumulative total of $939,817.00, budgeted from the Wastewater Fund, for the replacement of the Marine View Drive Pump Station force main – Specification No. PW10-0533F; and
- Clements Brothers, Inc., in the amount of $350,000.00, plus sales tax, for a cumulative total of $1,006,862.09, budgeted from the Capital Projects Fund, to increase the contract for additional project work associated with the Chinese Reconciliation Project – Specification No. PW08-0907F.
FINAL READING OF ORDINANCES
Ordinance No. 27938 amends Chapter 6B.1 0 of the Municipal Code, relating to general license provisions, to make all civil penalty amounts $250, to be consistent throughout the Municipal Code.
Ordinance No. 27939 amends Chapter 8.122 of the Municipal Code, relating to noise enforcement, to ensure notice requirements and appeal periods are consistent throughout the Municipal Code.
Ordinance No. 27940 amends Chapter 8.30 of the Municipal Code, relating to public nuisances, to clarify definitions, eliminate duplicate provisions, allow for consistent civil penalties, and add provisions for repeat offenders.
FIRST READING OF ORDINANCES
Ordinance No. 27941 amends Chapter 9.08 of the Municipal Code, relating to street occupancies, to exempt gardening activities for the street occupancy permit application and renewal fees.
COMMENTS AND COMMITTEE REPORTS OF THE CITY COUNCIL
Strickland encouraged citizens to vote.
